Terms of Service
1. Acceptance of these Terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. What Discoball Chat is
Discoball Chat is a communication tool that helps two people understand each other. When you send a message, your connected AI reshapes it, and the other person's connected AI rebuilds it in their world. Discoball Chat is the transport and interface; it does not itself provide the AI model — you do (see Section 4). The Service is in active development and its features may change.
3. Eligibility
You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.
4. "Bring your own AI"
- You connect your own third-party AI provider (for example Anthropic, OpenAI, or Google) using your own API key. You are responsible for that account, for keeping your key secure, and for all usage costs your provider charges.
- Your use of that provider is governed by that provider's own terms and policies. You are responsible for complying with them.
- The AI processes your message content to do its work. We are not responsible for the acts, omissions, availability, pricing, or data practices of any AI provider you choose to connect.
5. Your account
You are responsible for the activity under your account and for keeping your password secure. During alpha, access may be by invitation or admin approval. You must provide accurate registration information. Notify us promptly of any unauthorized use. You may delete your account at any time from Settings.
6. Acceptable use
You agree not to use the Service to:
- break the law, infringe others' rights, or facilitate harm;
- harass, threaten, defraud, impersonate, or deceive another person;
- send spam, malware, or bulk unsolicited messages;
- attempt to access accounts, data, or systems you're not authorized to;
- probe, scrape, overload, reverse-engineer, or interfere with the Service or its security, except as permitted by the Service's open-source license for the software itself;
- use the Service to manipulate, coerce, or emotionally exploit another person.
We may suspend or terminate accounts that violate these rules.
7. Your content
You keep ownership of the messages and content you create ("Your Content"). You grant Liminal Abundance a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you — including sending it to the AI provider you connect so it can be translated or reshaped. We do not sell Your Content and do not claim ownership of it. This license ends when Your Content is deleted, except for routine backups that rotate out over time.
8. AI output — no guarantees, not professional advice
Translations, suggestions, summaries, and other outputs are generated by AI and may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing anything before you send it and for what you ultimately send. The Service is a communication aid, not professional, legal, medical, financial, or mental-health advice, and is not a substitute for professional help or emergency services.
9. Fees
The Service is currently offered free of charge during alpha (you still pay your own AI provider directly). We may introduce fees for some features in the future; if we do, we will give notice and you can choose whether to continue.
10. Alpha status & availability
Discoball Chat is early software. It may be unavailable, change, or be discontinued at any time, and data may be lost. We do not guarantee any level of uptime, and we recommend you do not rely on the Service for anything critical during alpha.
11. Intellectual property
The Discoball Chat name, the Compass Discoball Chat Ball, logos, and the hosted Service are owned by Liminal Abundance. Portions of the underlying software are released under an open-source license in our public repository; your rights to that software are governed by that license, while these Terms govern your use of the hosted Service. Nothing here grants you rights to our trademarks.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LIMINAL ABUNDANCE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Liminal Abundance from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right, including any AI provider's terms.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination (for example ownership, disclaimers, limitation of liability, and indemnification) will survive.
16. Changes to these Terms
We may update these Terms as the Service develops. We will change the effective date above and, for material changes, provide more prominent notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
17. Governing law & disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us through our contact form so we can try to resolve the matter informally.
